Access Board releases 2011 ANPRM of ICT rule

Here is an early holiday present!

On December 8, 2011 the Access Board has released for public comment an advance notice of proposed rulemaking (ANPRM) updating accessibility requirements for information and communication technology (ICT) covered by Section 508 of the Rehabilitation Act and Section 255 of the Telecommunications Act. This latest version includes changes made in response to public feedback received on an earlier draft issued last year. It also includes several questions where additional public feedback is sought. The public comment period ends on March 7, 2012.

During the comment period, the Board will hold two public hearings, on January 11, 2012 in Washington, DC, and March 1, 2012 in San Diego, CA. A subsequent separate Federal Register notice will announce the hearings (ICT meeting notice). The hearing on January 11th will be held at the Access Board conference room at 1331 F Street, NW, Suite 800, Washington, DC, from 9:00 a.m. to noon. The hearing on March 1st will be held at the 27th Annual CSUN conference, Manchester Grand Hyatt, One Market Place, San Diego, CA, from 1:00 to 3:00 p.m. Persons wishing to speak at either hearing should preregister with Kathy Johnson, johnson@access-board.gov, (202) 272-0041 (v), or (202) 272-0082 (TTY).

All comments submitted during the public hearings will be posted to the rulemaking docket. After the public comment period closes, the Board will follow-up with a Notice of Proposed Rulemaking (NPRM) which will provide an additional round of comment before the rule is finalized.

Status of 508 Refresh

Hello Colleagues,

Here is the latest status of the Refresh of the Section 508 standards and Section 255 Guidelines:

At its July 13, 2011 meeting, the Access Board approved a motion to place the latest draft of the Information and Communications Technologies (ICT) guidelines and standards in the rulemaking docket once the Board’s ad hoc committee completed its work on the draft, which was expected to be the end of September. The Board approved this motion to facilitate collecting cost information and promote harmonization with standards efforts in Europe. Unfortunately, our work was not completed when we expected.

However, work will be completed before the Board’s next meeting in November. Therefore, the staff will be asking the Board to approve the next version of the ICT rulemaking on November 9. The next version will be an Advance Notice of Proposed Rulemaking; a public comment period will be provided on the ANPRM. This ANPRM will make changes in content and structure from the first ANPRM that was issued in March 2010. If the ANPRM is approved by the Board on November 9, we expect that it will be published in the Federal Register and made available on our website and Regulations.gov in early December.

When will Section 508 be updated?

On March 22, 2010, the Access Board released an Advance Notice of Proposed Rulemaking (ANPRM), as well as draft text of the proposed standards and guidelines, seeking comment on the proposed revisions to the Section 508 accessibility standards and Section 255 telecommunications accessibility guidelines. The rulemaking process started in September 2006 with the Telecommunications and Electronic and Information Technology Advisory Committee (TEITAC) reviewing the Section 508 Standard and Section 255 Telecommunications Guidelines and recommending changes. TEITAC presented a report of recommendations to the Access Board on April 3, 2008. This report served as input to the Access Board, which worked with an ad hoc committee of Board members and staff from several Federal agencies to develop the Advanced Notice of Proposed Rule Making (ANPRM) to solicit public comment.
